A legal disclaimer

SURETRAK Aerial Services provides drone-based construction site monitoring and aerial data services for informational and visual reference purposes only. All data, images, and models are subject to limitations based on environmental conditions, equipment capabilities, and FAA regulations.

We are not licensed surveyors or engineers; our services are not intended to replace official land surveying, structural inspections, or engineering analysis. Clients are responsible for verifying the accuracy of any data used for legal, architectural, or structural purposes.

All flight operations are conducted in compliance with FAA Part 107 regulations. Clients are responsible for securing necessary permissions for flights over private property or restricted areas.

SURETRAK Aerial Services is not liable for project decisions made based on drone data without professional consultation. Use of our services implies acceptance of these terms.

Terms & Conditions - the basics

1. Scope of Services

SURETRAK Aerial Services provides aerial imaging, video capture, mapping, and monitoring services using unmanned aerial systems (UAS) in accordance with FAA Part 107 regulations. Our services are strictly for visual documentation and project monitoring purposes and do not replace certified land surveying or engineering services.

2. Client Responsibilities

  • Clients must provide accurate site information, permissions, and necessary access for safe drone operation.

  • Clients are responsible for obtaining any required property owner or site manager authorization prior to flight.

  • Clients must notify us of any restricted areas, sensitive data, or safety hazards on-site.

3. FAA Compliance & Airspace Restrictions

  • All flights are conducted in compliance with FAA rules.

  • Services may be delayed or rescheduled due to FAA restrictions, weather conditions, or safety concerns.

  • In controlled airspace, additional FAA authorization may be required and could delay project timelines.

4. Data Use and Delivery

  • We deliver aerial photos, videos, maps, or models based on the agreed service package.

  • Unless otherwise agreed, clients are granted a non-exclusive license to use the final deliverables for internal or project-related purposes.

  • Raw data is not shared unless specified in the contract.

5. Payment Terms

  • Invoices are due [upon receipt / within 7 days / within 30 days] of delivery.

  • Late payments may be subject to a [5–10%] late fee.

  • For recurring monitoring, monthly payment schedules will be set in advance.

6. Cancellations & Rescheduling

  • Cancellations within 24 hours of the scheduled flight may incur a cancellation fee.

  • Weather-related or FAA-induced delays will be rescheduled at no extra charge.

7. Limitation of Liability

We are not responsible for damages, delays, or project outcomes based on the interpretation or misuse of aerial data. Our services are provided "as-is." We are not liable for any incidental, indirect, or consequential damages arising from our services.

8. Insurance

We maintain commercial liability insurance for UAS operations. Proof of insurance is available upon request.

9. Intellectual Property

All images, footage, and deliverables remain the property of SURETRAK Aerial Services until full payment is received. We reserve the right to use non-sensitive footage for marketing or portfolio purposes unless otherwise agreed.
